Please read these Terms & Conditions carefully before using this website or placing an order. By accessing or using Threads of Mercy (the "Site") or purchasing any product, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

Section 01

Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Threads of Mercy ("Company," "we," "us," or "our"), governing your access to and use of the website and all associated services.

By (i) visiting or browsing the Site, (ii) creating an account, (iii) placing an order, or (iv) checking the "I agree" checkbox at checkout, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

These Terms apply to all users of the Site, including without limitation browsers, customers, and contributors of content. We reserve the right to update these Terms at any time. Continued use of the Site after changes are posted constitutes acceptance.

Section 02

Eligibility

You must be at least 18 years of age to make a purchase on this Site. By using this Site, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding contract.

If you are between the ages of 13 and 17, you may only use the Site with the express consent and supervision of a parent or legal guardian who agrees to be bound by these Terms. Children under 13 are not permitted to use this Site.

By using the Site, you also represent that you are not located in a country subject to U.S. government embargo or sanctions, and that you are not listed on any U.S. government list of prohibited or restricted parties.

Account Registration

Certain features of the Site require you to create an account. When registering, you agree to provide accurate, current, and complete information and to update such information as necessary to keep it accurate.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account at support@threadsofmercy.com.

We reserve the right to terminate accounts, refuse service, or cancel orders at our sole discretion, including if we believe you have violated these Terms.

Guest checkout is available. By completing a guest checkout, you agree to these Terms without creating an account.

Section 04

Products & Pricing

Product Descriptions

We make every effort to display our products accurately. However, we do not guarantee that product descriptions, colors, images, or other content are accurate, complete, or error-free. Colors displayed on your screen may differ from the actual printed product due to monitor calibration and print process variation.

Pricing

All prices are listed in U.S. Dollars (USD) and are subject to change without notice. We reserve the right to correct pricing errors. If a product is listed at an incorrect price, we reserve the right to refuse or cancel orders placed at that price, whether or not the order has been confirmed.

Sales Tax

We collect and remit sales tax in accordance with applicable state and local laws. Sales tax is calculated at checkout based on your shipping address. By completing your purchase, you authorize us to collect applicable taxes.

Availability

Certain product styles, sizes, or colors may become unavailable without prior notice. We reserve the right to limit quantities or discontinue products at any time.

Section 05

Custom Design & Intellectual Property

Your Content License

When you upload artwork, images, graphics, or text ("User Content") through our design studio, you represent and warrant that:

  • You are the sole and exclusive owner of all intellectual property rights in the User Content, or you hold all necessary licenses, rights, consents, and permissions to use it and to authorize us to use it for fulfilling your order;
  • The User Content does not infringe, misappropriate, or violate any patent, copyright, trademark, trade secret, right of publicity, or any other intellectual property or proprietary right of any third party;
  • The User Content does not violate any applicable law, regulation, or these Terms.

By submitting User Content, you grant Threads of Mercy a non-exclusive, royalty-free, worldwide license to use, reproduce, process, and transmit your User Content solely for the purpose of fulfilling your order and as described in our Privacy Policy.

You are solely responsible for any copyright or trademark infringement claims arising from your custom designs. Threads of Mercy will not be held liable for User Content that infringes third-party rights.

Section 06

Prohibited Content Policy

You may not submit, upload, or request the printing of any design or content that:

  • Infringes any third-party copyright, trademark, or other intellectual property rights (including logos of sports teams, entertainment characters, celebrity likenesses, or brand marks without authorization);
  • Contains hate speech, slurs, or content that promotes discrimination based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, or age;
  • Depicts, promotes, or glorifies violence, terrorism, or illegal activity;
  • Contains sexually explicit, obscene, or pornographic material;
  • Depicts or targets minors in a sexual or harmful manner;
  • Contains defamatory, libelous, or harassing content targeting real individuals;
  • Violates any applicable federal, state, or local law or regulation.

We reserve the right to refuse, cancel, or decline to fulfill any order that we determine, in our sole discretion, violates this policy. Prohibited content orders will be cancelled and refunded. Repeated violations may result in permanent account termination and may be reported to law enforcement where required.

Section 07

Order Process & Cancellation

Order Confirmation

When you place an order, you will receive an order confirmation email acknowledging receipt. This email does not constitute acceptance of your order — acceptance occurs when your order enters production.

Cancellation Window

Because our products are made to order, orders enter production quickly — often within 1–2 hours of payment confirmation. You may request a cancellation by contacting us at support@threadsofmercy.com immediately after placing your order.

Once an order has entered the production queue, it cannot be cancelled or modified. We will make every effort to accommodate cancellation requests received before production begins, but we cannot guarantee cancellation after order placement.

If your cancellation request is successful, a full refund will be issued to your original payment method within 5–10 business days.

Section 08

Payment & Stripe

Payment Processing

All payments are processed securely through Stripe, Inc. ("Stripe"), a third-party payment processor. We accept Visa, Mastercard, American Express, and Discover.

By providing your payment information, you authorize Threads of Mercy and Stripe to charge the total order amount (including applicable taxes and shipping) to your selected payment method.

Stripe Terms

Your use of Stripe's services is subject to Stripe's own Terms of Service and Privacy Policy. We do not store your full credit card number, CVV, or other sensitive payment credentials — all such data is tokenized and handled by Stripe in accordance with PCI DSS standards.

Fraud Prevention

We use Stripe Radar and other fraud prevention tools. We reserve the right to cancel any order we reasonably believe is fraudulent. If your payment is flagged, we may contact you for additional verification before processing.

Currency & Chargebacks

All transactions are processed in U.S. Dollars. If you initiate a chargeback without first contacting us to resolve the issue, we reserve the right to dispute the chargeback and provide evidence of the completed order. Fraudulent chargebacks may result in account termination.

Section 09

Shipping & Delivery

All orders ship within the contiguous United States. Estimated delivery timelines:

Delivery timelines are estimates only and are not guaranteed. We are not responsible for delays caused by the carrier, weather, or other circumstances beyond our control. Risk of loss passes to you upon delivery to the carrier.

You are responsible for providing an accurate and complete shipping address. We are not liable for orders shipped to incorrectly provided addresses. Address corrections after production has begun may not be possible.

Section 10

Returns & Refunds

Please review our full Return & Refund Policy for complete details. Summary:

  • Unworn, unwashed items with original tags may be returned within 30 days of delivery;
  • Custom-printed items are non-returnable unless defective, damaged, or incorrectly printed;
  • Defective or incorrect items are eligible for a free reprint or full refund if reported within 30 days of delivery with photographic evidence;
  • Original shipping costs are non-refundable.

The Threads of Mercy name, logo, and all related product names, design marks, and slogans are trademarks of Threads of Mercy. All other trademarks, service marks, and logos on this Site are the property of their respective owners.

Permitted Use: You may view and download materials solely for your personal, non-commercial use, provided you retain all copyright and proprietary notices. You may not reproduce, distribute, sell, create derivative works from, or otherwise exploit any content for commercial purposes without our prior written consent.

Disclaimer of Warranties

THE SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

THREADS OF MERCY DOES NOT WARRANT THAT: (I) THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE; (II) DEFECTS WILL BE CORRECTED; (III) THE SITE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (IV) RESULTS FROM USE OF THE SITE WILL MEET YOUR REQUIREMENTS.

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THREADS OF MERCY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use of or inability to use the Site or our products;
  • Any unauthorized access to or use of our servers or your personal information;
  • Any interruption or cessation of transmission to or from the Site;
  • Any bugs, viruses, or similar issues transmitted through the Site by any third party;
  • Any errors or omissions in any content or any loss or damage incurred as a result of use of any content on the Site.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE TOTAL AMOUNT PAID BY YOU TO THREADS OF MERCY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

Some states do not allow limitations of liability for consequential or incidental damages, so the above limitations may not apply to you.

Section 14

Indemnification

You agree to defend, indemnify, and hold harmless Threads of Mercy and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms;
  • Your User Content, including any claim that your User Content infringes the intellectual property rights of any third party;
  • Your use of the Site or any products purchased from us;
  • Your violation of any applicable law or the rights of any third party.

Section 15

Governing Law & Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Informal Resolution

Before initiating any formal legal proceeding, you agree to first contact us at legal@threadsofmercy.com and provide a written description of the dispute. We will attempt in good faith to resolve the dispute informally within 30 days.

Binding Arbitration

If we cannot resolve a dispute informally, you and Threads of Mercy agree to resolve the dispute through binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Each party shall bear its own costs unless the arbitrator determines otherwise.

Class Action Waiver

YOU AND THREADS OF MERCY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Exceptions

Either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights.

Note: California customers may have additional rights under California law. Consult a licensed attorney for advice specific to your situation.

Section 16

DMCA / Copyright Infringement

We respect the intellectual property rights of others. If you believe that material on our Site infringes your copyright, please submit a DMCA takedown notice to our designated agent containing the following information (per 17 U.S.C. § 512):

  • A physical or electronic signature of the copyright owner or authorized agent;
  • Identification of the copyrighted work claimed to have been infringed;
  • Identification of the allegedly infringing material and its location on the Site;
  • Your contact information (name, address, telephone number, email address);
  • A statement of good faith belief that the use is not authorized by the copyright owner;
  • A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

We encourage you to review these Terms periodically. If you do not agree to the updated Terms, you must stop using the Site.
